Terms of Service

Welcome to EZY ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, web application, APIs, and associated services. By accessing or using EZY, you agree to be bound by these Terms and acknowledge our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

Definitions

• "EZY" refers to the online URL shortening, smart routing, dynamic QR code, and link management software platform accessible via ezy.pt, app.ezy.pt, and connected domains.
• "Service" refers to all websites, web applications, redirection engines, APIs, tools, and software features provided by EZY.
• "User" ("you" or "your") refers to any individual or entity accessing, browsing, or using the Service, whether as an unregistered visitor or a registered account holder.
• "Account" refers to the registered profile created by a User to manage links, QR codes, domains, and subscriptions on EZY.
• "Short Link" refers to a shortened hyperlink created on EZY that forwards incoming web visitors to a designated target destination URL.
• "QR Code" refers to a two-dimensional barcode generated through EZY that encodes a URL or Short Link for scanning by cameras and optical devices.
• "User Content" refers to all destination URLs, custom aliases, domain names, titles, notes, QR code customizations, and metadata provided or submitted by a User.

You must possess the legal capacity to enter into a binding agreement under applicable law to use the Service. If you are using the Service on behalf of a company, organization, or legal entity, you represent and warrant that you have full authority to bind that entity to these Terms.

The Service is intended solely for individuals who are at least sixteen (13) years of age. By accessing or using EZY, you represent and warrant that you are at least 13 years old. EZY does not knowingly offer the Service to or collect personal information from individuals under 13 years of age.

When creating an Account, you must provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials, session tokens, and passwords.

You are fully responsible for all actions, link creations, and interactions that occur under your Account. You agree to notify us immediately via our Support Center if you detect or suspect any unauthorized access or security breach regarding your Account.

4.1 Inactive Accounts Policy

To maintain database integrity and conserve system resources, if an Account remains completely inactive (with no user logins, link creations, or administrative activity) for twenty-four (24) consecutive months, EZY may delete the Account and its associated records. Where practical, we may attempt to send a courtesy reminder to the registered account email address prior to taking inactive account removal action.

4.2 User-Initiated Account Deletion

You have the right to delete your Account at any time directly through your dashboard settings via the "Delete Account" button. When you confirm account deletion:

• Your Account credentials, profile, and user records are permanently purged from active systems.
• All Short Links, custom slugs, and QR codes associated with your Account are deleted.
• Associated click analytics, telemetry logs, and tracking data are permanently erased.

5.1 Free and Paid Plans

EZY provides both a Free plan with core link-shortening capabilities and paid subscription plans (such as EZY Pro) offering increased creation allowances, custom branded domains, smart deep links, advanced QR customization, and extended analytics history. Plan features and quota allocations are detailed on our Pricing page.

5.2 Pricing, Currency and Stripe Processing

All subscription prices on EZY are displayed in United States Dollars (USD). Depending on your location, country of residence, card issuer, or bank, your financial institution or Stripe may charge you in your local currency (such as Euros) based on prevailing foreign exchange rates and applicable international transaction fees determined by your bank. EZY does not control or charge currency conversion fees.

EZY does not store full payment card numbers or card security codes (CVC/CVV) on its own systems. Payment card information is processed by Stripe. All transactions are encrypted and handled in accordance with applicable payment security standards.

5.3 Automatic Renewal

Paid subscriptions automatically renew at the conclusion of each billing period (monthly or annually) unless you cancel before the renewal timestamp. By subscribing, you authorize us and our payment processor to charge your designated payment method for the applicable renewal fee.

5.4 Refund Policy and Waiver of Right of Withdrawal

By purchasing a subscription, upgrading, or checking out, you expressly request and agree that the provision of digital services begins immediately. Consequently, you expressly waive your statutory right of withdrawal and any 14-day cooling-off or refund period.

All subscriptions are non-refundable. We only consider and grant refunds in rare, specific cases where an unresolvable technical fault on our platform directly prevents service usage, and our engineering team is unable to rectify the issue after receiving notice. Any refund granted under these circumstances is at our sole discretion.

To report an unresolvable technical fault for review:

• Submit a ticket through our Support Center or email billing@ezy.pt
• Include your account email, billing receipt, and detailed technical logs describing the fault
• Allow our engineering team up to 5 business days to investigate

5.5 Cancellation and Pro Expiration (Links Remain Active)

You may cancel your subscription at any time directly through your account billing settings. When your Pro subscription expires or is cancelled:

• Existing Short Links remain active: Your existing Short Links created during your Pro membership continue redirecting visitors normally. Subscription expiration does not disable or delete your existing shortened links.
• Account reverts to Free tier: Your account is downgraded to the Free plan limits. New link creations, custom domain additions, and deep link allocations will follow the standard Free tier allowances.
• Pro-only features and data: Advanced Pro capabilities (such as extended 90-day analytics retention and CSV exports) will be restricted to the Free plan limits.

Subscription expiration is distinct from voluntary Account deletion. Account deletion permanently removes all links and data, whereas subscription expiration merely transitions your account to Free tier limits.

5.6 Payment Failures and Chargebacks

If a recurring payment fails, Stripe will retry processing over a short grace period. If payment remains unresolved, your account will be suspended or downgraded to the Free tier.

Initiating an unauthorized or fraudulent chargeback may result in immediate Account suspension, link deactivation, and termination. We encourage Users to reach out to billing@ezy.pt first to resolve any billing inquiries.

5.7 Plan and Pricing Modifications

We reserve the right to modify our subscription prices, feature allocations, and monthly quotas. For active subscribers, any price adjustments will be notified at least thirty (30) days in advance and will apply only to subsequent billing cycles.

6.1 Link Creation and Dynamic Forwarding

EZY provides URL shortening, custom vanity paths, dynamic redirection, and mobile deep link capabilities. You are solely responsible for the content, destinations, and parameters of the links you generate.

6.2 No Guarantee of Indefinite Link Permanence

While EZY is engineered for continuous link routing, we do not guarantee that Short Links will remain available indefinitely. A Short Link may become unavailable due to:

• Voluntary Account deletion by the User;
• Account suspension or termination resulting from Terms violations;
• Compliance with applicable law, court orders, or law enforcement notices;
• Security countermeasures, malware detection, phishing reports, or spam mitigation;
• Unforeseen infrastructure disruptions, network failures, or technical incidents; or
• Discontinuation or restructuring of the Service in accordance with these Terms.

As noted in Section 5.5, the routine expiration or cancellation of a Pro subscription does not, by itself, disable or remove your existing Short Links.

6.3 QR Code Generation

You may customize, preview, and download QR codes generated on EZY. While codes adhere to standard ISO/IEC specifications, optical scanning speed and readability depend heavily on physical print contrast, lighting, and user camera hardware. We do not guarantee compatibility with all legacy scanning devices.

6.4 Analytics and Telemetry

EZY provides click telemetry, country-level geographic insights, device and browser breakdowns, and referrer tracking. Analytics metrics are compiled on a best-effort basis from incoming HTTP headers. External factors such as ad blockers, privacy extensions, VPNs, and browser security settings may impact telemetry precision.

6.5 Service Availability and Maintenance

We strive to maintain high service availability, but we do not guarantee uninterrupted, error-free operation. Scheduled maintenance, system updates, edge network latency, or unexpected server disruptions may temporarily affect link routing or dashboard access.

6.6 Beta and Experimental Features

From time to time, EZY may introduce features labeled as beta, preview, experimental, or early access. These features are provided "as is" and may contain defects, undergo substantial modifications, experience intermittent downtime, or be retired at our discretion without prior notice.

7.1 Destination Websites Disclaimer

EZY operates solely as a technical intermediary and link redirector. We do not control, monitor, verify, or endorse the content, safety, legality, products, accuracy, or privacy practices of external third-party websites or mobile applications reached through Short Links.

Users who click Short Links do so at their own risk. EZY shall not be held liable for any damages, losses, or security incidents resulting from interactions with third-party destination destinations.

7.2 Third-Party Infrastructure and Services

To provide the Service, EZY utilizes reputable third-party service providers, including payment processors, cloud hosting, authentication, database, storage, edge networking, and other infrastructure providers. These providers operate subject to their respective terms and privacy policies. For a detailed list of our core data processors, please refer to our Privacy Policy. EZY is not liable for failures, interruptions, or delays caused by third-party infrastructure beyond our reasonable control.

8.1 Prohibited Activities

You agree not to use the Service, directly or indirectly, to:

• Distribute, link to, or promote content that is illegal, defamatory, obscene, or fraudulent;
• Conduct phishing schemes, credential theft, account harvesting, or deceptive social engineering attacks;
• Disseminate malware, viruses, trojans, ransomware, spyware, or malicious executables;
• Operate fraudulent financial schemes, investment scams, pyramid operations, or deceptive commercial practices;
• Impersonate any individual, business entity, government authority, or public brand without authorization;
• Create or distribute Short Links for the purpose of evading URL or domain reputation systems, spam filters, browser security warnings, or automated moderation and security controls;
• Send unsolicited commercial bulk communications (spam) or facilitate abusive messaging;
• Infringe upon the intellectual property, privacy, publicity, or proprietary rights of any third party;
• Facilitate unlawful gambling, narcotics trafficking, weapons sales, or violent extremism; or
• Interfere with, compromise, probe, or disrupt the integrity, security, or performance of the Service.

8.2 Fair Use and Resource Abuse

To ensure high quality of service for all Users, you agree not to abuse or overload our infrastructure. Prohibited abuse includes:

• Intentionally creating excessive traffic floods designed to stress redirect edge servers;
• Creating multiple free accounts to circumvent link quotas, domain limits, or security restrictions;
• Deploying automated scripts, scrapers, or bots in a manner that degrades system performance; or
• Exploiting software vulnerabilities or attempting unauthorized penetration tests without prior written consent.

8.3 Link Removal and Immediate Enforcement

EZY reserves the right to immediately disable, suspend, or remove any Short Link, QR code, or custom domain that violates this Section or poses an active security threat, without prior notice. Where serious or repeated violations occur, we may suspend or permanently terminate the responsible Account and cooperate with law enforcement authorities to the extent permitted by applicable law.

The Service, including its user interface, algorithms, codebase, branding, designs, logos, and technical documentation, is owned by EZY and is protected by copyright, trademark, and intellectual property laws.

You retain ownership of the User Content (such as your target destination URLs and logos) you submit. By submitting User Content, you grant EZY a non-exclusive, worldwide, royalty-free license to store, process, and display such content strictly as required to provide, operate, and maintain the Service.

You may not copy, reverse engineer, decompile, distribute, or create derivative works of any part of EZY without our prior written authorization.

10.1 Immediate Suspension for Urgent Security Threats

We reserve the right to immediately suspend or terminate your Account, deactivate specific Short Links, or block access to the Service without prior notice where:

• Your Account or links are involved in phishing, credential theft, or fraudulent financial schemes;
• Your links redirect to malware, ransomware, spyware, or malicious executables;
• The Service is being used to distribute illegal content or violate child safety laws;
• Links are created to circumvent domain reputation systems, spam filters, or security controls;
• Your Account appears compromised or unauthorized third-party access is detected; or
• Immediate action is required to prevent imminent harm to users, the public, or our infrastructure.

10.2 Suspension with Notice for Non-Urgent Violations

For other material breaches of these Terms that do not present an immediate security, safety, or legal threat, EZY may, where practical and legally permissible, provide you with prior notice and a reasonable opportunity to remedy the breach before suspending or terminating your Account.

10.3 Effect of Termination

Upon termination for cause, your right to access and use the Service terminates immediately. Prohibited links and abusive resources may be deactivated and permanently purged from active systems. You may also voluntarily terminate your Account at any time through your dashboard settings.

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, statutory, or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the extent permitted by applicable law, EZY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of or inability to use the Service.

In any case, to the maximum extent permitted by applicable law, EZY's total aggregate liability arising out of or in connection with these Terms or the Service shall be limited to the total fees paid by you to EZY during the twelve (12) months preceding the incident, or fifty Euros (€50.00), whichever is greater.

Nothing in these Terms shall limit or exclude liability for intent, gross negligence, fraud, willful misconduct, death, or personal injury, or any other liability that cannot be limited or excluded under mandatory consumer protection laws in Portugal or the European Union.

You are solely liable for all links, destinations, and activities conducted under your Account. If you use the Service for illegal, fraudulent, or prohibited purposes, you acknowledge that you are solely responsible for any resulting legal consequences, including civil lawsuits, regulatory penalties, or criminal proceedings.

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless EZY, its operators, affiliates, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms, your User Content, or your misuse of the Service.

13.1 Mandatory Consumer Protections

Nothing in these Terms shall remove, limit, or exclude any mandatory statutory consumer rights that apply to you under the laws of Portugal, the European Union, or your country of habitual residence within the EU/EEA, where such rights cannot be derogated from by agreement.

13.2 Informal Resolution and Alternative Dispute Resolution (ADR)

If you have a dispute, concern, or question regarding the Service, you agree to contact us first at support@ezy.pt so that we may attempt to resolve the matter informally and amicably.

If a dispute cannot be resolved directly, consumers residing in Portugal or the European Union may access applicable consumer alternative dispute resolution (ADR / Entidades de Resolução Alternativa de Litígios de Consumo - RAL) mechanisms established under Portuguese law (Law no. 144/2015) and European consumer protection directives.

13.3 Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of Portugal, without giving effect to its conflict of laws principles.

Subject to any mandatory statutory provisions that grant consumers the right to resolve disputes in the courts of their habitual residence, any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Portugal.

14.1 Force Majeure

EZY shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, acts of war, terrorism, civil disturbances, strikes, power outages, telecommunication disruptions, third-party hosting outages, or denial-of-service attacks.

14.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be severed or modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 No Waiver

The failure or delay of EZY to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision in that or any subsequent instance.

14.4 Entire Agreement

These Terms of Service, together with our Privacy Policy and any guidelines expressly referenced herein, constitute the entire and exclusive agreement between you and EZY regarding the Service, superseding all prior proposals, discussions, or agreements.

14.5 Changes to Terms

We reserve the right to revise or update these Terms periodically. Notice of material changes will be provided by updating the "Last Updated" date at the top of this page. Your continued use of the Service after revised Terms take effect constitutes your binding acceptance of the updated Terms.
